1. INTRODUCTION
These Terms and Conditions govern the sale of products, digital content, and services provided by Fire In Your Face (“the Business”), operated by Thomas Makinson, a sole trader based in England and Wales.
By purchasing any product or service, you agree to be bound by these Terms. Please read them carefully before completing your purchase.

2. DEFINITIONS
In these Terms:
- “The Business” refers to Fire In Your Face, operated by Thomas Makinson.
- “You” or “Customer” refers to the individual purchasing products or services.
- “Digital Content” refers to all online courses, video content, and downloadable materials.
- “Physical Products” refers to fire manipulation torches and related equipment.
- “Services” refers to workshops, private lessons, and pro feedback services.
3. ELIGIBILITY
Participation in any fire-related training, whether online or in person, is strictly limited to individuals aged 18 or over.
There is no age restriction for purchasing physical products; however, all use of such products is undertaken entirely at the user’s own risk. The Business strongly recommends that fire manipulation equipment is only used by individuals aged 18 or over.
4. DIGITAL PRODUCTS (ONLINE COURSES)
4.1 Access
Access to digital content is granted immediately upon purchase.
4.2 Waiver of Cancellation Rights
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have a statutory 14-day right to cancel distance purchases. However, by expressly consenting to immediate access to digital content at checkout, you acknowledge and agree that you lose this right of cancellation once access has been provided.
This consent is obtained separately from your acceptance of these Terms and Conditions, through a dedicated confirmation at the point of purchase.
4.3 Refunds
No refunds will be provided once digital content has been accessed, except in cases of serious and verifiable technical failure that prevents access to the content entirely.
4.4 Usage Restrictions
All content is provided for your personal use only. You may not copy, share, distribute, reproduce, resell, or make available any content to third parties by any means.
4.5 Account Security and Control
You are responsible for maintaining the security of your account credentials. The Business reserves the right to suspend or terminate accounts where there is evidence of:
- Account sharing or unauthorised access
- Abnormal usage patterns
- Any breach of these Terms
4.6 Availability
Access to content may occasionally be interrupted due to maintenance, updates, or technical issues. The Business does not guarantee uninterrupted access and will not be liable for temporary unavailability.
4.7 No Guarantee of Results
The Business makes no guarantees regarding skill progression, competency, or ability to perform any techniques. Outcomes will vary depending on individual ability, practice, and application.
4.8 Content Changes
The Business reserves the right to update, modify, or remove content at any time. Access is provided for as long as the product remains available through the platform, and does not constitute a guarantee of unchanging content.
4.9 Communication
You are responsible for providing accurate contact details and for monitoring communications from the Business. The Business is not responsible for missed messages sent to the contact details you have provided.
5. PROFESSIONAL FEEDBACK SERVICES
5.1 Scope
Feedback is provided at the Business’s discretion and may vary in depth, format, and response time depending on the nature of the submission.
5.2 Fair Usage
Use of feedback services must remain reasonable. The Business reserves the right to restrict or terminate access in cases of excessive or unreasonable use.
5.3 Response Times
The Business will aim to respond within 24–72 hours, but this is not guaranteed. Response times may vary depending on demand and availability.
5.4 Missed Feedback
If you believe feedback has not been received, you must notify the Business within 7 days of submission. The Business cannot investigate claims raised after this period.
5.5 Expiry
Access to feedback services expires after the specified period (typically 12 months from purchase) and does not renew automatically. No refunds will be provided for unused portions of the service.
5.6 Conduct
Abusive, threatening, or inappropriate behaviour directed at the Business or any of its representatives may result in immediate termination of access without refund.
5.7 User Submissions
You are solely responsible for all content you submit for feedback. You must not submit content that depicts or involves unsafe practices, illegal activity, or anything that endangers yourself or others.
The Business reserves the right to refuse to review any submission it considers unsafe, inappropriate, or in breach of these Terms.
The Business accepts no responsibility or duty of care for activities carried out during the creation of submitted content. You acknowledge that any practice undertaken for the purposes of recording a submission is done entirely at your own risk.
6. PHYSICAL PRODUCTS (FIRE TORCHES)
6.1 Nature of Products
Products are intended as training and performance equipment for fire manipulation.
6.2 Use at Own Risk
All products are used entirely at your own risk. The Business accepts no liability for injury, burns, fire damage, property damage, or any other consequences arising from the use of its products.
6.3 Responsibility
You are solely responsible for how, where, and under what conditions products are used. It is your responsibility to ensure that you have appropriate training, safety equipment, and a suitable environment before use.
6.4 Modification
Any modification, alteration, or tampering with products voids all responsibility and liability on the part of the Business.
6.5 Wear and Tear
Products are subject to normal wear and tear through use. No guarantee is provided regarding product lifespan under usage conditions.
6.6 Storage and Handling
You are solely responsible for the safe storage, maintenance, and handling of all equipment purchased from the Business.
6.7 Safety Information
Any safety information provided with products is for general guidance only and is not exhaustive. It does not replace proper training or professional advice.
6.8 Orders and Pricing
All prices are displayed at the point of purchase and are inclusive of VAT where applicable. The Business reserves the right to amend pricing at any time, but changes will not affect orders already placed and confirmed.
6.9 Delivery
The Business offers delivery within the United Kingdom and internationally.
Standard lead time is 3–5 working days from the date of order confirmation. Delivery timeframes are estimates and are not guaranteed. The Business will make reasonable efforts to fulfil orders within the stated timeframe but accepts no liability for delays caused by third-party carriers or circumstances beyond its control.
Risk in the products passes to you upon delivery. If a product is lost in transit, you must notify the Business within 14 days of the expected delivery date.
6.10 Custom and Made-to-Order Products
Where products are made to order or customised to your specification, the statutory 14-day right to cancel does not apply under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Standard (non-customised) products may be returned within 14 days of delivery provided they are unused, in their original condition, and in original packaging. The cost of return shipping is your responsibility.
6.11 Faulty or Damaged Products
Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described. If a product arrives damaged or is found to be faulty, you must notify the Business within 30 days of delivery.
Where a valid claim is accepted, the Business will offer a repair, replacement, or refund at its discretion. The cost of return shipping for faulty or damaged items is the responsibility of the customer.
7. WORKSHOPS AND IN-PERSON TRAINING
7.1 Nature of Activity
Participation in workshops and in-person training involves inherent and significant risk, including but not limited to risk of burns, fire-related injury, and smoke or fuel vapour inhalation. By booking and attending, you acknowledge and accept these risks.
7.2 Participant Responsibilities
Participants must:
- Follow all instructions given by the instructor at all times
- Wear appropriate clothing as advised prior to the session
- Prepare appropriately in accordance with any pre-session guidance
- Disclose any relevant medical conditions, injuries, or disabilities that may affect participation
7.3 Behaviour
The Business reserves the right to remove any participant from a session without refund if they:
- Fail to follow safety instructions
- Behave in a manner that is dangerous to themselves or others
- Are under the influence of drugs or alcohol
- Behave in an abusive, threatening, or disruptive manner
7.4 Filming and Recording
Filming or recording during workshops is not permitted unless explicitly authorised by the Business in advance.
7.5 Media Use
The Business may capture photographs or video during sessions for promotional and marketing purposes. Participants will be given the opportunity to opt out of media use at the time of booking or prior to the session. If you do not wish to appear in promotional material, you must notify the Business in writing before the session takes place.
7.6 Cancellation by the Business
If a session is cancelled by the Business for any reason, a full refund will be provided.
7.7 Cancellation by Participant
No refunds are provided for participant cancellations. This policy is clearly stated on the product page at the time of booking. By completing your booking, you acknowledge and accept this policy.
7.8 Certification
Any certificate issued following a workshop or training session is a certificate of participation only. It does not represent competency, qualification, or authorisation to perform fire manipulation independently or professionally.
8. LIABILITY
8.1 Limitation of Liability
To the fullest extent permitted by law, the Business shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of its products, services, or content.
8.2 Personal Responsibility
You accept full responsibility for all actions taken based on any instruction, product, or service provided by the Business, including any injury, loss, or damage caused to yourself, other individuals, or property.
8.3 Public Use
Any use of techniques or skills learned through the Business in public, professional, or unsupervised environments is undertaken entirely at your own risk and responsibility.
8.4 Nature of Instruction
All instruction provided by the Business, whether online or in person, is general guidance only. It may not account for all situations, environments, or individual circumstances.
8.5 Legal Compliance
You are responsible for ensuring compliance with all applicable laws and regulations in your location, including but not limited to fire safety regulations, public performance licences, and insurance requirements.
8.6 Third-Party Impact
The Business accepts no responsibility for any damage, injury, or loss caused to third parties as a result of your actions, whether arising from use of products, application of techniques, or any other engagement with the Business.
8.7 Non-Excludable Rights
Nothing in these Terms seeks to exclude or limit liability where it cannot legally be excluded or limited under UK law, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
9. DATA AND PRIVACY
The Business collects and processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

By using our services, you acknowledge that you have read and understood our Privacy Policy.
10. INTELLECTUAL PROPERTY
All content provided by the Business, including but not limited to course materials, videos, images, text, branding, and website content, remains the intellectual property of Fire In Your Face.
You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from any content without the prior written permission of the Business.
11. TERMINATION
The Business reserves the right to suspend or terminate your access to any product or service, without refund, where these Terms have been breached.
In cases of serious breach, the Business may take such action immediately and without prior notice.
12. FORCE MAJEURE
The Business shall not be liable for any failure or delay in the performance of its obligations where such failure or delay results from events beyond reasonable control, including but not limited to illness, injury, natural disaster, pandemic, government action, or unforeseen circumstances.
13. CHARGEBACKS AND FRAUD
Fraudulent chargebacks or unjustified payment disputes may result in:
- Immediate suspension or termination of your account and access to all services
- Recovery of all associated costs, including administrative and legal fees
- Legal action where appropriate
If you have a genuine concern about a payment, you are encouraged to contact the Business directly before raising a dispute with your payment provider.
14. DISPUTE RESOLUTION
If you have a complaint or dispute regarding any product or service, you should first contact the Business directly using the details provided in Section 18. The Business will make reasonable efforts to resolve the matter informally.
If the matter cannot be resolved informally within 30 days, either party may pursue formal legal proceedings in accordance with Section 16.
15. INTERNATIONAL USERS
Users accessing products or services from outside the United Kingdom do so at their own risk and are solely responsible for compliance with all applicable local laws and regulations.
The Business makes no representation that its products, content, or services are appropriate or available for use in jurisdictions outside the United Kingdom.
16. GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
17. CHANGES TO THESE TERMS
The Business reserves the right to update or amend these Terms at any time. Changes will be effective from the date they are published. Continued use of the Business’s products or services following any changes constitutes acceptance of the updated Terms.
